Long Term Care Planning and Elder Law

Elder Law, or “Long Term Care Planning,” encompasses the special legal needs of individuals with memory impairment or declining physical health. While we incorporate many of the same planning techniques that we use in Estate Planning - Wills, Trusts, Powers of Attorney, Health Care Proxies and Living Wills - a comprehensive Long Term Care plan is structured for each individual or couple to achieve the right balance between quality of life, personal control, and preservation of assets.

In this area of our practice, we:

Work with financial and insurance professionals to integrate Long Term Care Insurance into a client's overall estate plan
Develop plans for establishing eligibility for Medicaid
Draft Irrevocable Medicaid Trusts and deeds with retained life estates
Assist with trust funding and asset transfers
File Medicaid applications and provide related advice on all Medicaid funded health care programs, including the Lombardi program and other home care programs
Represent clients in fair hearings and other administrative and court proceedings involving Medicaid eligibility
Draft Caregiver Compensation Agreements
Work with Geriatric Care Counselors to develop private and/or publicly funded home care plans
Assist families in establishing  Guardianship for adults who lack capacity
Advise Trustees of Revocable Living Trusts and Irrevocable Medicaid Trusts on trust distributions, and review annual accountings to determine impact on Medicaid eligibility
